Você pode repassar o instalador original, sem cobrar e sem alterar. Não pode vender, modificar, fazer engenharia reversa nem tirar os avisos. O Autor não é obrigado a fornecer o código-fonte. O programa não envia seus dados de trabalho ao Autor. É oferecido sem garantia. As versões 0.5.8 e anteriores continuam sob a licença com que foram distribuídas (Apache 2.0). Este é um contrato entre você (pessoa física ou jurídica, "Você") e Carlos Alvarenga, Brasil ("Autor" ou "Licenciante"), titular do programa de computador PrumoGrid ("Software"). Ao instalar ou usar o Software, Você aceita esta licença. Se não concordar, não o instale. 1. CONCESSÃO. O Autor concede a Você uma licença gratuita, não exclusiva, mundial e por prazo indeterminado para instalar e usar o Software em quantos computadores quiser, para qualquer finalidade lícita, inclusive uso comercial e uso interno de empresas e de seu grupo econômico, por seus empregados e prestadores de serviço. 2. REDISTRIBUIÇÃO. Você pode copiar e repassar o instalador oficial, desde que (a) inalterado, (b) sem cobrar nada por ele e (c) com esta licença e os avisos de autoria intactos. 3. RESTRIÇÕES. Você não pode: (a) vender, alugar, sublicenciar ou cobrar pelo Software, por cópias ou pelo acesso a ele; (b) incluí-lo em produto ou serviço pago sem autorização escrita do Autor; (c) modificar, descompilar, desmontar ou fazer engenharia reversa do Software, salvo quando a lei expressamente o permitir; (d) distribuir versões alteradas; (e) remover ou alterar avisos de autoria, licença ou marcas. 4. CÓDIGO-FONTE. Esta licença abrange o Software em forma executável. O Autor não tem obrigação de fornecer, publicar ou manter disponível o código-fonte, nem de prestar suporte, correções ou atualizações. 5. PROPRIEDADE. O Software é protegido pela Lei nº 9.609/1998 e pela Lei nº 9.610/1998. Todos os direitos não concedidos expressamente aqui ficam com o Autor. Esta licença não transfere propriedade. 6. COMPONENTES DE TERCEIROS. O Software inclui componentes de terceiros (Electron, xterm.js, node-pty, koffi, fontes e outros) que continuam sob suas próprias licenças, listadas em THIRD_PARTY_NOTICES.md e em LICENSES.chromium.html, que acompanham o Software. Nada nesta licença restringe os direitos que essas licenças dão a Você. 7. PRIVACIDADE E REDE. O Software não envia ao Autor seus projetos, arquivos, comandos, conteúdo dos terminais nem dados de uso; não tem telemetria nem conta de usuário; relatórios de falha ficam só no seu computador. A única conexão feita por iniciativa do próprio Software é a consulta de nova versão em https://downloads.prumogrid.dev (ao abrir e a cada 6 horas, sem cookies nem identificador), que pode ser desligada em Opções avançadas > Aplicativo > Atualizações; o instalador novo só é baixado com sua confirmação. Nessa consulta, o servidor recebe os dados técnicos de qualquer acesso à internet, como o endereço IP, tratados conforme a Lei nº 13.709/2018 (LGPD). Programas que Você executa nos terminais, comandos que configura e extensões que instala seguem as políticas de seus próprios fornecedores. 8. MARCAS. "PrumoGrid" e seus logotipos são sinais do Autor. Esta licença não autoriza usá-los de forma que sugira endosso, parceria ou origem diferente da real. 9. SEM GARANTIA. O Software é fornecido gratuitamente "no estado em que se encontra", sem garantia de adequação a um fim específico, de funcionamento ininterrupto ou de ausência de erros. Prazo de validade técnica de cada versão (Lei nº 9.609/1998, art. 7º): até a publicação da versão seguinte do Software. 10. LIMITAÇÃO DE RESPONSABILIDADE. Na máxima extensão permitida pela lei brasileira, o Autor não responde por lucros cessantes, perda de dados, interrupção de atividades ou danos indiretos decorrentes do uso do Software. Nada aqui afasta responsabilidade que a lei não permita excluir, inclusive por dolo ou culpa grave, nem direitos de quem for consumidor nos termos da Lei nº 8.078/1990 (CDC). 11. RESCISÃO. Esta licença termina automaticamente se Você descumprir qualquer condição; nesse caso, pare de usar o Software e apague as cópias. As cláusulas 4, 5, 6, 9, 10 e 12 continuam valendo. 12. LEI E FORO. Aplicam-se as leis da República Federativa do Brasil. Fica eleito o foro do domicílio do Licenciante, ressalvado o direito do consumidor de demandar no foro do seu domicílio. 13. VERSÕES, IDIOMA E CONTATO. Novas versões do Software podem vir com nova licença; o Software mostra a licença nova e pede aceite antes de instalar. During that check the server receives the technical data of any internet request, such as the IP address, handled under Brazilian Law 13,709/2018 (LGPD). Programs You run in the terminals, commands You configure and extensions You install follow their own vendors' policies. 8. TRADEMARKS. "PrumoGrid" and its logos belong to the Author. This license does not allow using them in a way that suggests endorsement, partnership or a different origin. 9. NO WARRANTY. The Software is provided free of charge "as is", without warranty of fitness for a particular purpose, uninterrupted operation or absence of errors. Technical validity period of each version (Law 9,609/1998, art. 7): until the next version of the Software is published. 10. LIMITATION OF LIABILITY. To the fullest extent permitted by Brazilian law, the Author is not liable for lost profits, data loss, business interruption or indirect damages arising from use of the Software. Nothing here excludes liability that the law does not allow to be excluded, including for willful misconduct or gross negligence, nor the rights of consumers under Law 8,078/1990 (Consumer Protection Code). 11. TERMINATION. This license ends automatically if You breach any of its terms; in that case stop using the Software and delete your copies. Clauses 4, 5, 6, 9, 10 and 12 survive. 12. GOVERNING LAW AND VENUE. The laws of the Federative Republic of Brazil apply. The courts of the Licensor's domicile are chosen, without prejudice to a consumer's right to sue in the courts of their own domicile. 13. VERSIONS, LANGUAGE AND CONTACT. New versions of the Software may come with a new license; the Software shows it and asks for acceptance before installing.
